N.Y. officer accidentally shoots man while showing off gun
The (Westchester, N.Y.) Journal News

NEW ROCHELLE, N.Y. — Eastchester police Officer James Pileggi was arraigned Wednesday afternoon in the fatal off-duty shooting of a New Rochelle man Tuesday night, and his lawyer afterward called it a tragic accident.

"This is a terrible tragedy," lawyer Angelo MacDonald said outside New Rochelle City Court, "but unfortunately an accident."

He added, about the manslaughter charge against Pileggi, "This is an overcharge and may be unprovable."

Pileggi, 29, of Centre Avenue, New Rochelle, was charged with second-degree manslaughter, a felony, in the fatal shooting of Andre Everett, 27, of 17 Albert Place. Bail was set at $50,000.

Pileggi was suspended with pay Wednesday from the police department.

Pileggi and two acquaintances - 29- and 33-year-old men, both from New Rochelle - were parked in Everett's driveway in Pileggi's car around 8:46 p.m. Pileggi was in the passenger seat "showing off" his 9mm off-duty weapon that was equipped with a laser, New Rochelle Capt. Joseph Schaller said. Everett was standing outside the car.

Pileggi "recklessly discharged the weapon" striking Everett in the throat, Schaller said.

Everett was taken to Sound Shore Medical Center where he was declared dead at 9:40 p.m. Tuesday.

Eastchester Police Chief Timothy Bonci said Pileggi has been on the Eastchester force for two years. Before that, he spent four years as a Mount Vernon police officer.

In Eastchester, Pileggi's duty performance was good, Bonci said.

Whoops. Perhaps he shouldn't have a badge if he is going to be "accidentally" shooting folks?

I don't think it was accidental. Seems he was being a dumbass on purpose. Why would you point a loaded gun at your buddy?

Well there is a situation like that! He did that in front of a commanding officer. He deserves to be locked away with the criminals for being stupid. Sad, because from what they ssay he was actually a good cop.

Yeah, that was a classic video. I can't believe he went for another weapon after that. I'll give him credit for continuing his seminar though.

You know what's funny, is that I know a good amount of individuals that know this guy. They say he's a great DEA Agent and not an arrogant fuck wad like he portrayed that day.

Both of those idiots (NY cop & DEA agent) forgot 2 rules. Never point a weapon at anything you're not ready to destroy and always assume the weapon is loaded. My personal rule/behavior they violated is that you never raise your weapon from the muzzle down position without first clearing it twice whenever you draw it in a non-aggressive manner. If either of them had cleared their weapons immediately after drawing them then this wouldn't be a problem.

When I goto bed I:
1. draw my weapon
2. clear it
3. put the ejected round back in the mag
4. clear it again
5. function check the slide/trigger/striker
6. reload the mag
7. chamber a round
8. place in the top draw of my nightstand with the muzzle facing the concrete exterior wall and not a less dense interior wall

That's not a bad deal Jax! You can never be to say when handling a firearm.
