Here is another question that comes up frequently from people. The "castle doctrine" one of the best laws made for residents of Florida. This gives a person the legal right to use deadly force to defend their place , and/or any other innocent persons legally inside it from violent attack or an intrusion which may lead to an attack.

Q. What if someone is attacking me in my own home?
A. The courts have created an exception to the duty to retreat called the “castle doctrine.” Under the castle doctrine, you need not retreat from your own home to avoid using deadly force against an assailant. The castle doctrine applies if you are attacked in your own home by an intruder or an invited guest.





Q. What if I am in my place of business and someone comes in to rob me? Do I have to retreat before using deadly force?
A. The castle doctrine also applies when you are in your place of business. If you are in danger of death or great bodily harm or you are trying to prevent a forcible felony, you do not have to retreat before using deadly force in self-defense.

Florida's "Castle Doctrine" law does the following:

One: It establishes, in law, the presumption that a criminal who forcibly enters or intrudes into your home or occupied vehicle is there to cause death or great bodily harm, so the occupant may use force, including deadly force, against that person.

Two: It removes the "duty to retreat" if you are attacked in any place you have a right to be. You no longer have to turn your back on a criminal and try to run when attacked. Instead, you may stand your ground and fight back, meeting force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself or others.

Three: It provides that persons using force authorized by law shall not be prosecuted for using such force. It also prohibits criminals and their families from suing victims for injuring or killing the criminals who have attacked them. In short, it gives rights back to law-abiding people and forces judges and prosecutors to focus on protecting victims.

In this day and age that is huge. It's bad enough you had to make that choice to pull, but now having to face a law suit by the shit bags family who wants millions from you cause you killed their crappy child while he/she had broken into your house or buisness.

It's very good, its nice to see something working out for the victim for once. I am sure it is still a hassle, but lets face it when it comes to protecting yourself or family in your own house, their should be no debate.

In this day and age that is huge. It's bad enough you had to make that choice to pull, but now having to face a law suit by the shit bags family who wants millions from you cause you killed their crappy child while he/she had broken into your house or buisness.

But they're always such good kids! At least according to the Sun-Sentinel. :D

True. The Slantinel also seems to pick and choose which article they want to link to comments. There's certainly is a pattern to which ones....

Thats where the brainwashing begins. This allows them to feel they will be forgiven for their acts. This also gives them something to fall back on when they are imprisoned and become born again idiots.

the place to live and protect property is Texas. you can defend your neighbors property with deadly force as long as he/she asked you to watch over it while they are not there.

most states have some sort of castle doctrine, TN has one as well but there are a few things that need to be adjusted about it. in Fla, your car is a direct extension of your castle. TN has not gotten that far yet. the sooner we can get King Jimmy Naifeh out of his house speaker position (the house speaker can kill ANY vote no matter if it is going to pass or not) we might have a chance to get a fwe laws removed or rewritten.

Previously, the castle doctrine didnt extend to the garage of your home.. Im pretty sure the garage counts now (since the revisions were made I believe in Oct 07???) It also applies to your vehicle too.
